Man shot by police outside Orlando gas station has died, officials say

ORLANDO, Fla. — A man shot by officers outside of an Orlando gas station Friday afternoon has died, the Orlando Police Department said.

OPD identified him as Marvin Martin, age 63.

“Due to unknown complications, the suspect has since passed away,” the agency announced on Saturday.

The shooting unfolded around 2 p.m. Friday outside a Circle K/BP gas station on John Young Parkway near Old Winter Garden Road.

OPD officers and Orange County deputies were called to the location after receiving multiple calls about a man dressed in all black holding a gun along the road, OPD said.

“There is busy business at BP so you have to make a judgment call, you got to act,” said OPD Chief Eric Smith.

The area was flooded with law enforcement, who tried to talk with the man and gave him commands to drop his gun, according to OPD.

As a result, the officers were forced to shoot. “He put my officers in a position where they had to defend themselves and protect the community,” said Chief Smith. “You have to keep the public safe, and that’s your primary job.”

The suspect was taken to the hospital and is expected to be ok. While his name has not been released yet, OPD officials say the suspect has a long criminal record. He had been convicted of multiple charges in the past – including aggravated battery and theft.

The suspect had also been sentenced to 20 years behind bars for second-degree murder in Miami Dade County and was released in 2023, according to OPD.

The officer was placed on leave, and the Florida Department of Law Enforcement is conducting an investigation into the case - which is standard procedure every time a shooting involves a police officer.

“I think for an officer it’s always scary, and anytime you receive that call of a person with a gun and walking around an intersection, you know one of that kind of things are being done for a reason,” said Chief Smith.

Following the shooting and his arrest, Martin faced charges that included resisting without violence, possession of a firearm by a convicted felon, and unlawful exhibition of a firearm.

Orlando police said despite Martin’s death, their investigation into the incident remained active.
