ORANGE COUNTY, Fla. — The man Troopers arrested for hitting and killing an Orange County kindergarten student this weekend is undocumented, Florida Highway Patrol told prosecutors Friday.

In open court, a Florida Highway Patrol trooper told prosecutors Rosillo Arriola handed him an ID from Mexico after he admitted to hitting and killing an Orange County student a 6-year-old named Emiliano.
Since the tragedy happened, 9 Investigates has been questioning FHP and ICE on the suspect’s status.

This weekend’s arrest marked his 3rd DUI in Florida.
Rosillo-Arriola is still on probation for his 2nd DUI from October 2023.

FHP told prosecutors in court that ICE placed a detainer on Rosillo-Arriola.
Prosecutors stressed to the judge that they should not grant bond for him because he’s a flight risk and that he could try to flee to Mexico now that he is facing several years in prison for Manslaughter and DUI.

A judge granted pretrial detention Friday at the State Attorney’s office request.
The Foundation for Orange County Public Schools has set up a Memorial Fund to help raise money to send Emiliano’s remains to Guatemala.
